Terms of Service

1. Eligibility and accounts

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service, and you must have your parent's or guardian's permission if you are under the age of majority where you live. You are responsible for the information in your account, for keeping your password secure and for all activity under your account. Tell us right away at support@carameru.app if you suspect unauthorised use.

2. Plans, subscriptions and payments

• Carameru offers a free plan with ads and paid plans (Caramel Plus and Caramel Pro) billed monthly or annually. Features and prices are shown before you subscribe and may vary by country and currency.
• Paid plans renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time; cancellation takes effect at the end of the current period and you keep access until then.
• First-time subscribers may be offered a free trial. Unless you cancel before the trial ends, you will be charged for the plan you selected when the trial ends. Trials are limited to one per person.
• Purchases made on the web are processed by Stripe and can be managed from your profile. Purchases made in the Android or iOS app are processed by Google Play or the Apple App Store and are subject to their terms; manage or cancel them from your store account.
• Except where required by law or by the applicable app store's policies, payments are non-refundable and we do not provide refunds or credits for partial billing periods.
• We may change our prices or plans. We will give you reasonable advance notice of any price change for your subscription, and the change will apply from your next renewal.

3. Your content

You keep ownership of the recipes, photos, comments and other content you post ("Your Content"). By posting Your Content, you grant Carameru a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (for example, resize images) and distribute it in order to operate, improve and promote the Service. This licence ends when you delete Your Content or your account, except for copies other users have saved or that we must keep by law.

You are responsible for Your Content and confirm that you have the rights to post it and that it does not infringe anyone else's rights. If you add co-authors to a recipe, they can be credited and manage it with you.

4. Acceptable use

You agree not to:

• Post content that is illegal, harmful, hateful, harassing, sexually explicit, misleading or that infringes intellectual property or privacy rights.
• Post food-safety information you know to be dangerous, or impersonate any person or organisation.
• Spam, scrape, or collect other users' information without permission.
• Interfere with or disrupt the Service, attempt to access accounts or systems without authorisation, or reverse engineer the apps except as permitted by law.
• Use the Service, including its AI features, to build a competing product or in violation of any law.

5. Moderation

We may remove or hide content and suspend or close accounts that violate these Terms or put the Service or others at risk. Recipe authors can hide or delete comments on their own recipes. We are not obliged to monitor content but may do so.

6. AI features

Pro subscribers can use features powered by artificial intelligence, such as meal-plan generation, recipe suggestions and importing recipes or ingredients from photos. AI output can be inaccurate or incomplete. Review it before relying on it, especially ingredients, quantities, allergens and cooking instructions. AI features are subject to fair-use limits.

7. Health, allergy and food-safety disclaimer

Recipes, nutritional information and suggestions on Carameru are provided for general information only and are not medical, nutritional or dietary advice. Many recipes are posted by other users and are not verified by us. Always check ingredients and labels for allergens, follow safe food-handling practices, and consult a qualified professional about any medical condition, allergy or dietary need. You cook and eat at your own risk.

8. Advertising and third-party services

The free plan includes advertising. The Service may also link to or integrate with third-party services (such as payment processors, sign-in providers and YouTube videos). Those services are governed by their own terms and we are not responsible for them.

9. Our intellectual property

The Service, including its software, design, logos and the Carameru name, is owned by Carameru and protected by law. These Terms grant you a personal, non-transferable, revocable licence to use the Service for its intended purpose; they do not grant you any other rights to our intellectual property.

10. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service, in which case we will give you reasonable notice where possible. Sections that by their nature should survive termination will survive.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not guarantee that the Service will be uninterrupted, secure or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Carameru will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law, including your rights as a consumer.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of Mexico, without regard to conflict-of-law rules, and any dispute will be submitted to the competent courts of Mexico, unless the consumer-protection laws of the country where you live give you the right to bring claims there or require a different law to apply.
